We reserve the right to terminate or restrict your access to Secret Tunnel without prior notice if we suspect any violation of law, infringement on others’ rights, or other misuse of our service.

You agree to use Secret Tunnel responsibly, ethically, and in full compliance with these terms. You are responsible for all activities conducted under your account and will not engage in any unauthorized or prohibited use of Secret Tunnel.

We reserve the right to terminate or suspend your access to Secret Tunnel at our discretion, without prior notice, for any breach of these terms or for any other reason.

To the fullest extent permitted by law, Emerging Markets LLC, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (i) your use or inability to use Secret Tunnel, (ii) any unauthorized access, use, or alteration of your transmissions or content, or (iii) any conduct or content of any third party using Secret Tunnel.

You agree to defend, indemnify, and hold harmless Emerging Markets LLC, its affiliates, and its respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of Secret Tunnel; (ii) your violation of these terms; (iii) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right; or (iv) any claim that your use of Secret Tunnel caused damage to a third party.

Secret Tunnel is provided on an "as-is" and "as-available" basis. Emerging Markets LLC makes no representations or warranties of any kind, express or implied, as to the operation of Secret Tunnel, or the information, content, or materials included therein. You expressly agree that your use of Secret Tunnel is at your sole risk. We do not warrant that Secret Tunnel will be uninterrupted, error-free, or completely secure.

By signing up for Secret Tunnel, you consent to receive phone calls, emails, and transactional or service text messages from us, sent to the phone number and email address associated with your account. These communications may include updates, account information, order confirmations, and other service-related messages. Standard message, data, and calling rates may apply. You may opt out of these communications at any time by following the instructions provided in the messages. For marketing text messages, see Section 16.

We may modify these terms and conditions at any time. Changes become effective upon posting on the Secret Tunnel website. Continued use of Secret Tunnel constitutes acceptance of any updated terms.

Users retain ownership of any content they submit through Secret Tunnel. However, by submitting content, you grant Emerging Markets LLC a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, and display such content for purposes of operating and improving the service. We reserve the right to monitor, edit, or remove content at our sole discretion.

By using Secret Tunnel, you agree to our data collection and privacy practices as outlined in our Privacy Policy. This may include the collection and storage of certain personal information. We are not liable for any unauthorized access to or use of your data unless resulting from our gross negligence or intentional misconduct.

Any dispute or claim arising out of or relating to these terms, or the breach thereof, shall be settled by binding arbitration in [said jurisdiction], except that either party may seek injunctive relief in any court of competent jurisdiction. Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA). Judgment on the award may be entered in any court having jurisdiction.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

These terms and conditions are governed by the laws of the applicable jurisdiction, without regard to conflict of law principles.

This section governs marketing text messages, which are separate from the service communications described in Section 9. Marketing SMS is offered on a per-organizer basis: you opt in to a specific event organizer’s list, either by checking an unchecked consent checkbox at checkout or by texting that organizer’s keyword to our number. Message delivery is subject to your mobile carrier, and carriers are not liable for delayed or undelivered messages.
